Terms & Conditions | Sensible & Tailor-Made Itineraries
The administration of a pre-packaged Sensible Itinerary or a tailor-made itinerary involves considerably more resource than a direct lodge booking. If a prospective visitor requests a sensible itinerary or mandates the independent administrator to tailor-make an itinerary, the following Terms & Conditions will apply.
NOTE: References to Exclusive Ecolodges, 'we', 'our', and 'us' are to Exclusive Ecolodges New Zealand Limited and its independent administrator, and references to 'you' and 'your' are to you the client.
PAYMENT
You will pay to Exclusive Ecolodges a non-refundable deposit of 25% of the total price for your itinerary within seven [7] days of confirming your itinerary. Failure to pay this deposit within the seven [7] days may result in the cancellation of your itinerary by Exclusive Ecolodges. Your booking with Exclusive Ecolodges is complete upon receipt by us of this deposit.
Full and final payment of the balance of the total price payable in accordance with your itinerary must be paid to the Exclusive Ecolodges' administrator no later than sixty [60] days prior to day one of your itinerary. Exclusive Ecolodges shall have the right to cancel your booking if full and final payment is not received by this date.
In the event you confirm your itinerary within sixty [60] days of day one of your itinerary, you will pay to Exclusive Ecolodges the total price payable in accordance with your itinerary within seven [7] days of confirmation.
Any further costs that you may be required to pay to Exclusive Ecolodges, including, but not limited to, any costs payable as a result of any change, amendment or alteration to your itinerary, are to be paid within seven [7] days of notification received from Exclusive Ecolodges.
All payments should be made in New Zealand Dollars (unless advised otherwise):

PRICE
Exclusive Ecolodges will quote the total price payable for each itinerary at the time of presentation to you. The price quoted will only be in respect of the accommodation, transfers, activities, meals, guiding and other services to be provided, arranged or managed by Exclusive Ecolodges as detailed in your itinerary. Exclusive Ecolodges may alter the total price payable at any time in its sole and absolute discretion.
All prices quoted by Exclusive Ecolodges are in New Zealand Dollars (NZ$) unless otherwise indicated, are inclusive of New Zealand Goods and Services Tax (GST) chargeable in accordance with the Goods and Services Tax Act 1985, and are subject to any increase in GST by the New Zealand government.
CANCELLATION
It is recommended that you purchase COMPREHENSIVE TRAVEL INSURANCE. This is to cover you should you need to cancel your trip or make any emergency arrangements during your holiday.
In the event you cancel your booking with Exclusive Ecolodges you will be subject to certain costs.You agree and acknowledge that immediately upon cancellation of your booking at any time your deposit of 25% shall be forfeited.
In the event you cancel your booking within sixty [60] days of day one of your itinerary you will forfeit the following portion of the total price paid to Exclusive Ecolodges in accordance with your itinerary:
- 59-31 days before day one of your itinerary: 40%
- 30 days or less before day one of your itinerary: 100%
If adverse weather means that you are unable to complete an activity then you will receive a full refund at the completion of your trip.
If a guided Milford Track or Routeburn Track booking is included in your trip arrangements, as per track policy, there is a $NZ200 per person cancellation policy and no refund if cancelled within sixty [60] days of the hike's commencement.
Exclusive Ecolodges will refund to you the balance of the total price paid not forfeited in accordance with these Cancellation terms within twenty [20] days of receiving notification of your cancellation.
REFUND
Exclusive Ecolodges will not refund to you any monies paid in respect of your itinerary once your itinerary has commenced.Exclusive Ecolodges will not refund to you any monies in respect of any tours, accommodation, activities or other services included in your itinerary that you have not used for any reason, unless cancelled by the activity operator - this is at the activity operator's discretion.
ADDITIONAL EXPENSES
The price only includes the accommodation, transfers, activities, meals, guiding and other services that are to be provided, arranged or managed by Exclusive Ecolodges. Certain additional expenses may be incurred and will be your sole responsibility.International and New Zealand departure taxes, customs and any immigration fees and visas that you may require are not included in the price.Items of a personal nature are not included in the price. These include, but are not limited to: any additional activities, meals, beverages and the like not detailed in your itinerary, pre-registration or late check out of rooms, laundry, phone calls, tipping and room service. In the event you elect to self-drive, any running costs and insurance excess associated with the rental vehicle are not included in the price.
INDEPENDENT ARRANGEMENTS
You may at anytime make your own arrangements that are in addition to, or different from, your itinerary prepared by Exclusive Ecolodges. Any such arrangements will be made entirely at your own risk and your rights will lie solely against the organizations supplying or providing such arrangements.ACCOMMODATIONAll accommodation in your itinerary will be based on "Run of House" rooms, unless specifically mentioned otherwise. Exclusive Ecolodges has no control over which room may be allocated to you by the accommodation provider.
EXCLUSIVE ECOLODGES NEW ZEALAND LIMITED
Exclusive Ecolodges may, in its sole and absolute discretion, change, amend, alter your itinerary at any time after your itinerary is confirmed. Exclusive Ecolodges may further substitute any service provider detailed in your itinerary for another of a similar or higher standard after your itinerary is confirmed. Exclusive Ecolodges shall notify you as soon as practicable in the event of any such change, amendment, alteration or substitution. You agree and acknowledge that any costs payable as a result of any change, amendment, alteration or substitution to your itinerary, are to be paid by you in accordance with the payment terms.
DISCLAIMER
Exclusive Ecolodges offers creation, management and support services for your vacation in New Zealand. We undertake to perform these services with reasonable skill and care. Exclusive Ecolodges acts at all times as your agent to introduce you to the service providers included in your itinerary. We do not own or operate the accommodation, transport, activities or other services included in this website or that may be included in your itinerary. Exclusive Ecolodges does not accept any responsibility or liability of any nature for any acts, omissions, defaults or failures, whether negligent or otherwise, on the part of those service providers.
We do not accept any liability for personal injury, death, delay, loss of any nature, property damage, inconvenience or additional expenses, resulting from acts, omission or negligence whatsoever of Exclusive Ecolodges, its agents, contractors or any other service providers or operators, including, but not limited to, any liability arising from delayed departure, missed carrier connections, substitutions of accommodation or transportation, termination of service, changes in price, cancellation or double bookings of reservations, or the failure of any service provider at any time. Exclusive Ecolodges does not accept any liability for any changes to, or cancellation of, your itinerary for health or safety reasons.
Exclusive Ecolodges does not at any time accept any liability in relation to your failure to obtain the correct and required documentation for travel in and to New Zealand (including, but not limited to, passports, visas and health certificates). Further, Exclusive Ecolodges does not accept any liability in relation to your failure to obtain travel insurance, follow instructions (including but not limited to check in, check out and departure places and times) or the delay or loss of, or damage to, your luggage or its contents. On booking with Exclusive Ecolodges you are deemed to warrant that you maintain a reasonable standard of fitness and health as may be required to participate in your itinerary. In the event you will require medical and/or physical assistance you must be accompanied by a companion. Exclusive Ecolodges, its suppliers, agents and contractors do not provide this service.
FORCE MAJUERE
Exclusive Ecolodges will be not responsible or liable for any damage, loss, delay, additional expenses or inconvenience caused directly or indirectly by any events which are beyond our control, including, but not limited to: war, threat of war, riot, civil strife, industrial dispute, terrorist activity, natural or nuclear disaster, fire, adverse weather conditions, acts of God, acts, demands, orders or requirements of any government, government agency or other authorities, technical problems affecting transport or any other circumstances amounting to force majuere events beyond our control.
APPLICABLE LAW
Exclusive Ecolodges terms and conditions are governed by, and construed and interpreted in accordance with the laws of New Zealand and shall be subject to the exclusive jurisdiction of the New Zealand Courts.
GENERAL
Exclusive Ecolodges may amend or vary these terms and conditions at any time. Any amendments will be effective immediately when posted on our website.If any provision of these terms and conditions is held by a competent authority to be invalid or unenforceable in whole or in part, the validity of the other provisions of these terms and conditions and the remainder of the provisions in question shall not be affected.Any heading used in these terms and conditions is for ease of reference only, and shall not affect the interpretation or construction of these terms and conditions.
